These Terms & Conditions (“Terms”) govern your use of theipacs.com (the “Website”) and the services offered by The iPac Services LLP (“The iPACS”, “we”, “us”, “our”). By using the Website or engaging our services, you agree to these Terms.
1. Our services
We provide brand development, graphic design, UI/UX design, website and application development, e-commerce and digital marketing services. The exact scope, deliverables, timeline and fees for each engagement are set out in a written proposal, quotation or agreement (the “Proposal”). If a Proposal conflicts with these Terms, the Proposal prevails for that engagement.
2. Use of the Website
- You agree to use the Website only for lawful purposes.
- You must not attempt to disrupt, overload or gain unauthorised access to the Website or its systems.
- You must provide accurate information when you contact us or apply for a role, and use an email address you own.
3. Quotations and payments
- Quotations are valid for 30 days unless stated otherwise.
- Projects typically begin after an advance payment as stated in the Proposal; remaining payments are due at the milestones agreed.
- Invoices are payable within the period stated on the invoice. Applicable taxes (including GST) are charged in addition to the quoted fees.
- We may pause work on a project if payments are overdue.
4. Client responsibilities
You agree to provide content, feedback, approvals and access (for example to domains, hosting or third-party accounts) in a timely manner. Delays in providing these may move delivery dates. You confirm that any material you give us (text, images, logos, data) is yours to use or properly licensed.
5. Revisions and changes
Each Proposal states the number of revision rounds included. Requests beyond the agreed scope or revisions are treated as change requests and may be quoted separately.
6. Intellectual property
On receipt of full payment, ownership of the final approved deliverables created specifically for you transfers to you, except for third-party assets (fonts, stock images, plugins, open-source code) which remain subject to their own licences, and our pre-existing tools, code libraries and know-how, which we license to you for use with the deliverables. Unless agreed otherwise in writing, we may display completed work in our portfolio.
7. Third-party services
Websites and apps often rely on third-party providers such as hosting, domain registrars, payment gateways, email and app stores. Their availability, pricing and terms are outside our control, and their fees are payable by you unless included in the Proposal.
8. Confidentiality
Both parties will keep confidential any non-public business information received from the other and use it only for the engagement.
9. Warranties and limitation of liability
We perform services with reasonable skill and care. Except as expressly stated, the Website and services are provided “as is”. To the maximum extent permitted by law, our total liability for any claim relating to an engagement is limited to the fees paid to us for that engagement, and we are not liable for indirect or consequential losses such as loss of profit, data or business.
10. Applications under development
Information on the Website about products under development (including our upcoming dating/friendship application, owned by The iPac Services LLP) is for general information only and may change. Separate terms will apply to those products when launched.
11. Careers and internships
Job and internship listings are invitations to apply and do not constitute an offer of employment. We never charge any fee to candidates for applications, interviews or internships. If anyone asks you for payment in our name, please report it to info@theipacs.com.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.
13. Governing law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts in India where The iPac Services LLP is registered.
